1. Introduction

Welcome to Work Tracker (hereinafter referred to as the "Application"). These Terms of Service ("Terms") govern your use of the Application provided by VP Utils ("we," "us," or "our").

By downloading, installing, or using the Application, you agree to be bound by these Terms. If you disagree with any part of these Terms, you must immediately uninstall the Application and discontinue its use.

2. Beta Release Notice

You acknowledge that the Application is currently in a Beta Release phase.

• Experimental Nature: The Application is still under development and may contain bugs, errors, or stability issues.
• No Guarantee: We do not guarantee that the Application will function without interruption or errors.
• Data Loss: While the Application processes data locally on your device, we are not responsible for any loss of data, settings, or configurations resulting from the use of this Beta version.

3. License to Use

We grant you a personal, non-exclusive, non-transferable, revocable license to use the Application for your personal, non-commercial use, subject to these Terms. You agree not to:

• Reverse engineer, decompile, or disassemble the Application.
• Use the Application for any illegal or unauthorized purpose.
• Exploit the Application to distribute malware or compromise the security of other devices.

4. Intellectual Property

The Application, including its original content, features, and functionality (e.g., code, artwork, UI design), remains the exclusive property of VP Utils. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of the Developer.

5. User-Generated Content and Local Data

As outlined in our Privacy Policy, the Application operates on a "Zero-Knowledge" basis.

• Local Storage: Any content you create, input, or modify within the Application resides solely on your device.
• Responsibility: You are solely responsible for backing up your own data. We have no access to your data and cannot recover it for you if you uninstall the Application or if your device is lost or damaged.

6. Disclaimer of Warranties ("As Is")

THE APPLICATION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

To the fullest extent permitted by law, we expressly disclaim all warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no warranty that the Application will meet your requirements or be secure, accurate, or error-free.

7. Limitation of Liability

In no event shall VP Utils be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of (or inability to access or use) the Application.
• Any conduct or content of any third party on the Application.
• Any bugs, crashes, or glitches inherent to the Beta software.

Limitation Cap: To the extent permitted by applicable law, our total liability to you for any claims arising out of these Terms or your use of the Application shall be limited to the amount you paid us, if any, for accessing the Application (or $10 USD if the Application is free).

8. Third-Party Services

The Application may contain links to third-party websites or services that are not owned or controlled by us. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Application after those revisions become effective, you agree to be bound by the revised terms.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Czech Republic, without regard to its conflict of law provisions.
